GENERAL TERMS AND CONDITIONS
Introduction
This contractual document shall govern the General Conditions for contracting services (hereinafter, “Conditions”) through the website ibizajetskibeach.com, owned by ALTAIR NAUTICA SL under the trademark of , hereinafter, ALTAIR NAUTICA SL, whose contact details also appear in the Legal Notice of this website.
These Conditions shall remain published on the website available to the CLIENT for reproduction and storage as confirmation of the contract, and may be modified at any time by ALTAIR NAUTICA SL. It is the responsibility of the CUSTOMER to read them periodically, as those in force at the time of placing the order will be applicable.
Contracts shall not be subject to any formality with the exception of the cases expressly indicated in the Civil and Commercial Codes and in this or other special laws.
The acceptance of this document implies that the CUSTOMER:
- You have read, understand and comprehend the above.
- You are a person with sufficient capacity to contract.
- You assume all obligations set forth herein.
These conditions will have an indefinite period of validity and will be applicable to all contracts made through the ALTAIR NAUTICA SL website.
ALTAIR NAUTICA SL informs that the merchant is responsible and aware of the legislation in force, and reserves the right to unilaterally modify the conditions, without affecting the terms and conditions that were implemented prior to the modification.
Identity of the contracting parties
On the one hand, ALTAIR NAUTICA SL, the PROVIDER of the services contracted by the CLIENT is ALTAIR NAUTICA SL, with registered office at Calle Sant Jaime, Nº39 4-1, – 07840 Santa Eulalia Del Rio (Illes Balears), NIF B07820509 and customer/USER service telephone number 645871590.
And on the other hand, the CLIENT, registered on the website by means of a user name and password, for which he/she has full responsibility for the use and custody, and is responsible for the veracity of the personal data provided to ALTAIR NAUTICA SL.
Object of the contract
The purpose of this contract is to regulate the contractual sales relationship between ALTAIR NAUTICA SL and the CLIENT when the CLIENT accepts the corresponding box during the online contracting process.
The contractual sales relationship involves the delivery, in exchange for a specific price and publicly displayed through the website, of a specific service.
Rectification of data
When the CLIENT identifies errors in the data published on the website or in the documents generated by the contractual relationship, he/she may notify ALTAIR NAUTICA SL at info@calabassajetski.com so that ALTAIR NAUTICA SL can correct them as soon as possible.
The CLIENT may keep their data updated by accessing their user account.
Recruitment procedure
The CLIENT, in order to access the services offered by ALTAIR NAUTICA SL, must be of legal age and register through the website by creating a user account. Therefore, the CLIENT must freely and voluntarily provide the personal data that will be required, which will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April 2016 (GDPR) on the protection of natural persons with regard to the processing of personal data and the free movement of such data and Organic Law 3/2018 of 5 December (LOPDGDD) on the protection of personal data and detailed in the Legal Notice and Privacy Policy of this website.
The CLIENT will select a user name and password, undertaking to make diligent use of the same and not to make them available to third parties, as well as to notify ALTAIR NAUTICA SL of the loss or theft of the same or possible access by an unauthorised third party, so that the latter may proceed to block them immediately.
Once the user account has been created, we inform you that in accordance with the requirements of article 27 of Law 34/2002, on Information Society Services and Electronic Commerce (LSSICE), the contracting procedure will follow the following steps:

1. GENERAL TERMS AND CONDITIONS
Unless otherwise stipulated in writing, the placing of an order with ALTAIR NAUTICA SL shall imply acceptance by the CUSTOMER of these legal conditions. No stipulation made by the CLIENT may differ from those of ALTAIR NAUTICA SL if it has not been expressly accepted in advance and in writing by ALTAIR NAUTICA SL.
2. ACTIVATION OF SERVICES
ALTAIR NAUTICA SL will not activate any service until it has verified that payment has been made.
As the order does not entail the physical delivery of any product, the contracted services being downloaded or activated directly from the website, ALTAIR NAUTICA SL will previously inform the CLIENT of the procedure to be followed to carry out this download or activation.
Failure to perform the contract remotely
In the case of the provision of a service, this will be available from the moment the CUSTOMER has paid for it and may be downloaded or activated according to the conditions of ALTAIR NAUTICA SL.
In the event that the contract does not involve the physical delivery of any product, but rather a download activation on a website, ALTAIR NAUTICA SL will previously inform the CUSTOMER of the procedure to be followed to carry out this download.
In the event of not being able to execute the contract because the contracted service is not available on time, the CUSTOMER will be informed of the lack of availability and will be entitled to cancel the order and receive a refund of the total amount paid at no cost, and without any liability for damages attributable to ALTAIR NAUTICA SL.
In the event of unjustified delay on the part of ALTAIR NAUTICA SL with regard to the refund of the total amount, the CUSTOMER may claim to be paid double the amount due, without prejudice to its right to be compensated for any damages suffered in excess of this amount.
ALTAIR NAUTICA SL will not assume any responsibility when the download or activation of the service is not carried out, due to the data provided by the CLIENT being false, inaccurate or incomplete.
The provision of the service will be considered to have been carried out when the CLIENT has downloaded or activated the service.
3. RIGHT OF WITHDRAWAL

The CUSTOMER has a period of fourteen calendar days from the date of receipt of the product or from the conclusion of the contract of sale if it is a provision of a service, to exercise the right of withdrawal, regulated in Article 102 of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, hereinafter RDL 1/2007. If ALTAIR NAUTICA SL does not comply with the duty to provide information and documentation on the right of withdrawal, the period for its exercise will end twelve months after the expiry date of the initial withdrawal period, in accordance with article 105 of RDL 1/2007.
The right of withdrawal shall not apply to the contracts referred to and listed in article 103 of RDL 1/2007, and which are listed here
All returns must be communicated to ALTAIR NAUTICA SL, requesting a return number using the form provided for this purpose, or by e-mail to info@calabassajetski.com, indicating the corresponding invoice or order number.
4. RECLAMACIONES Y RESOLUCIÓN DE CONFLICTOS EN LÍNEA

Online Dispute Resolution (Online Dispute Resolution)
In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the CLIENT and ALTAIR NAUTICA SL, without the need to resort to the courts of law, through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between the two. This body is neutral and will dialogue with both parties in order to reach an agreement, and may finally suggest and/or impose a solution to the conflict.

5. FORCE MAJEURE
The parties shall not be liable for any failure due to force majeure. Performance of the obligation will be delayed until the case of force majeure ceases.
COVID-19: If due to mobility restrictions or any other reason related to the consolidated rules in the COVID-19 code, the CLIENT cannot receive the service, he/she will be refunded the full amount of the registration fee or will have the possibility to use his/her reservation until ……………… or a new date proposed by ALTAIR NAUTICA SL.
The activity is affected by weather conditions (rain, state of alert, sea conditions and rescue guidelines,…) as well as social circumstances (demonstrations, strikes, public holidays,…) beyond our control. Therefore, Altair Náutica S.L. may slightly modify the content of the reservations when, due to this type of unforeseeable circumstances, the activities and timetables cannot be carried out in the same way as stated in the online reservation offer. In this case, the suppliers will try to provide the service in the best possible way, substituting the services that cannot be enjoyed by others of similar purpose and cost.
6. COMPETENCE
The CLIENT may not assign, transfer or transfer the rights, responsibilities and obligations contracted in the sale.
Should any stipulation of these conditions be considered null and void or impossible to fulfil, the validity, legality and fulfilment of the rest shall not be affected in any way, nor shall they be modified in any way.
The CLIENT declares that he/she has read, knows and accepts these Conditions in their entirety.
7. GENERAL INFORMATION ABOUT THE OFFER
All sales made by ALTAIR NAUTICA SL shall be understood to be subject to these Conditions.
No modification, alteration or agreement contrary to ALTAIR NAUTICA SL’s Commercial Proposal or to what is stipulated herein shall have any effect, unless expressly agreed in writing signed by ALTAIR NAUTICA SL, in which case these particular agreements shall prevail.
Given the continuous technical advances and improvements in services, ALTAIR NAUTICA SL reserves the right to modify its specifications with respect to the information provided in its advertising, as long as it does not affect the value of the services offered. These modifications will also be valid in the event that, for any reason, the possibility of supplying the services offered is affected.
8. PRICE AND PERIOD OF VALIDITY OF THE OFFER
The prices indicated for each service include Value Added Tax (VAT) or other taxes that may be applicable. These prices, unless expressly stated otherwise, do not include the costs of shipping or communication, handling, packaging, shipping insurance or any other additional and ancillary services to the service purchased.
The prices applicable to each service are those published on the website and shall be expressed in EURO currency. The CLIENT assumes that the economic valuation of some of the services may vary in real time.
Before making the purchase you will be able to check online all the details of the quote: services, quantities, price, availability, charges, discounts, taxes and the total of the purchase. Prices may change daily until the order is placed.
Once the order has been placed, prices will be maintained whether the service is available or not.
Any payment made to ALTAIR NAUTICA SL entails the issuing of an invoice in the name of the registered CLIENT or the company name that the CLIENT has informed at the time of placing the order. This invoice may be requested by e-mail info@calabassajetski.com and sent in PDF format to the e-mail address provided by the CUSTOMER, provided that he/she has given his/her express consent to do so, informing him/her that he/she may revoke said consent at any time by informing ALTAIR NAUTICA SL by e-mail.

9. TRANSPORT COSTS
There are no transport costs.
10. FORMS OF PAYMENT, CHARGES AND DISCOUNTS
ALTAIR NAUTICA SL is responsible for the economic transactions and offers the following methods of payment for an order:
- Credit or debit card
The CLIENT may use a discount coupon prior to the completion of the purchase in the event of having received it from ALTAIR NAUTICA SL.
When formalising the reservation, 100% of the activity will be charged, if cancelled within the time limits given, all or part of the amount will be refunded if the cancellation is subject to a penalty (it is recommended that you read the conditions carefully).
Security measures
The website uses information security techniques generally accepted in the industry, such as SSL, data entered on a secure page, firewalls, access control procedures and cryptographic mechanisms, all with the aim of preventing unauthorised access to data. To achieve these purposes, the CLIENT accepts that ALTAIR NAUTICA SL obtains data for the purpose of the corresponding authentication of access controls.
ALTAIR NAUTICA SL undertakes not to allow any transaction that is or is considered illegal by the credit card brands or the acquiring bank, which may or has the potential to damage their goodwill or negatively influence them.

11. PURCHASING PROCESS

Within a maximum of 24 hours, on working days, an e-mail will be sent to the CLIENT confirming the status of the order and the approximate download and/or activation date.
12. DISSOCIATION AND SUSPENSION OR TERMINATION OF THE CONTRACT
If any of these terms and conditions shall be deemed unlawful, void or for any reason unenforceable, this condition shall be deemed severable and shall not affect the validity and enforceability of any of the remaining conditions.
ALTAIR NAUTICA SL may, without prior notice, suspend or terminate the CLIENT’s access to its services, in whole or in part, for any valid reason, including, without limitation, when the CLIENT fails to comply with or follow any of the obligations set out in this document or any applicable legal provision, licence, regulation, directive, code of practice or usage policy.
When exercising any of its rights or powers under this Clause, such exercise shall not prejudice or affect the exercise of any other right, power or remedy that may be available to .
13. WARRANTIES AND RETURNS
The guarantees will respond to what is regulated in the Title referred to “Guarantees and after-sales services” of the Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, which you can access by clicking here.

Changes to the booking
There will be no extra cost for customers to change the date of their booking for a different date by reliable means, provided that it is at least 48 hours before the date of the booking and that there are places available. Cancellation of the booking
The cancellation of the booking of the different activities offered will be subject to this policy and general terms and conditions and to the particular conditions that may be established at the time of payment. In general, Altair Náutica S.L. allows cancellation at no cost to the Client;

If the cancellation is made during the last 72 hours, the cancellation will entail a penalty of 50%, which will be detailed in the offer.
In any case, cancellations within the last 24 hours will not entitle to any refund of the amount paid and 100% of the amount per activity will be charged.
For group bookings of more than 5 jet skis, the cancellation of the booking will be free of charge as long as it is made at least 14 days before the date of the activity. However, if the cancellation is made within the last 72 hours, 50% of the amount paid for the booking will be forfeited. And if you do not show up for the activity or cancel within the last 24 hours, 100% of the price per activity will be charged.
If any activity has a particular cancellation policy, this will be reflected in the offer, during the booking process and on the voucher or voucher of the booking.
14. APPLICABLE LAW AND JURISDICTION
These conditions shall be governed by or interpreted in accordance with Spanish law in all matters not expressly established.
Any dispute that may arise from the provision of the products or services covered by these Conditions shall be submitted to the courts and tribunals of the domicile of the CUSTOMER, the place of fulfilment of the obligation or the place where the property is located if it is immovable.

The User declares that:

In the event of contracting by a minor, Altair Náutica S.L. shall in no case be liable and the minor, parents or guardians must assume the costs that this may cause.
The use of the WEB site implies an agreement between the user and Altair Náutica S.L., whereby the user expressly accepts full and unreserved adherence to each and every one of the General Terms and Conditions published by Altair Náutica S.L. at the very moment the User accesses this portal, especially those established regarding the limitation of liability of both Altair Náutica S.L. and any provider of tourist or excursion services. Therefore, the User must carefully read the General Terms and Conditions each time he/she intends to use the WEBSITE, given that they may have been modified since the last time he/she accessed the WEBSITE.
Altair Náutica S.L. understands that those who make use of its WEB SITE, booking the various activities, comply with the necessary legal requirements regarding the capacity to enter into these contracts and that, in doing so, they tacitly accept to be subject to the terms and conditions specified in the following sections.

REGISTRATION – USER

In the purchase process and always before the end of the same, the User will have all the information relating to the full final price, including taxes, breaking down, where appropriate, the amount of increases or discounts that are applicable to the offer and the additional costs that are passed on to the User, the User being responsible for providing their data correctly, including their personal data and bank details required by the system.
All bookings made on our WEB site are recorded and therefore automatically archived in our system.
In addition, the system automatically sends the booking information to the customer’s e-mail address along with the booking reference number and all the information on how to pay and send the documentation of your activity. Altair Náutica S.L. provides an online booking method, fast, available 24 hours a day and secure. Bookings are made through the website www.ibizajetskibeach.com . Given the diversity of the activities, they may require different methods of payment or different days in advance in order to make the reservation according to the demand and occupancy in that activity.
The data entered by the User shall be truthful and the property of the User, especially those relating to the means of payment.
Exceptionally, in the event that it is not possible to book online on the day requested, Altair Náutica S.L. shall be available to Customers through info@ibizajetskibeach.com who shall be responsible for resolving the problem or providing other alternatives of interest to them. Modifications to the booking

LIMITATION OF LIABILITY
Altair Náutica S.L. offers a wide range of leisure and sporting activities on its website that require the User to be in full physical and psychological condition. It is the responsibility of the User to inform Altair Náutica S.L. of any circumstances relating to their health that may pose a risk to the User or third parties during the activity, and Altair Náutica S.L. shall be entitled to refuse the booking. It is the responsibility of the client to locate the departure point of activities, to call or contact Altair Náutica S.L. if he/she has any doubts. The User must always be punctual, and as a general rule it is advisable to be there 15 to 20 minutes before the scheduled time. If the User arrives late or is not at the agreed time, he/she will not be entitled to any refund of the amounts previously paid or of any possible expenses incurred.
Altair Náutica S.L. shall not be liable for weather conditions or any other force majeure circumstances beyond the control of Altair Náutica S.L. shall not be liable for the loss of personal belongings of the Users during the activities. Nor shall it be liable for any damages suffered by Users or their death in the different activities when they have acted recklessly, without due diligence, as well as disobeying the instructions and guidelines determined by the monitors of such activity. Likewise, in the case of adventure activities, Users accept under their own responsibility when contracting these activities the possible risks that they and the minors in their custody may incur in carrying out the same. Therefore, Altair Náutica S.L. has taken out civil liability insurance, as well as accident insurance for each activity contracted and its liability is therefore covered within the legal conditions of said contracts.
Altair Náutica S.L. makes every effort to update, maintain and operate its WEB site, offering the User this site as a tool for obtaining services, however, Altair Náutica S.L. cannot guarantee the absence of technical failures, the total security of the WEB service, nor that it will be operational 24 hours a day, seven days a week at all times.
